About RICO Law
The Racketeer Influenced and Corrupt Organization Act commonly referred to as the RICO Act became a federal law in 1970. The origin of the RICO Act was to eradicate organized crime connected with the Mafia.
Before the RICO Act was enacted, federal prosecutors could only try each individual mob member for a particular crime, rather than charging the criminal organization as a whole. Not only does the RICO Act give prosecutors the ability to do this, but the law is also used to prosecute street gangs, businesses, and even politicians.
The following all fall under the heading of white collar crime and are often RICO offenses:
- Fraud
- Extortion
- Insider trading
- Embezzlement
- Counterfeiting
- Identity theft
- Money laundering
- Bribery
A conviction for a single RICO charge is punishable by a maximum federal prison sentence of 20 years–or life imprisonment if the underlying offense is murder–and a fine of up to $250,000 or twice the proceeds obtained from the offense. Additionally, the government can freeze the defendant’s assets prior to the case even going to trial in order to prevent the defendant from having enough time to hide the assets.
